Mesafeli Satış Sözleşmesi ve Gizlilik Politikası

Mesafeli Satış Sözleşmesi

Madde 1 – Taraflar

Satıcı: Roumelie Orientale, E-posta: info@roumelieorientale.com · Site: www.roumelie.com

Alıcı: www.roumelie.com üzerinden sipariş veren kişi. Alıcı'nın adı, adresi ve iletişim bilgileri sipariş sırasında girdiği bilgilerdir.

Madde 2 – Konu

Bu sözleşme, Alıcı'nın www.roumelie.com üzerinden sipariş verdiği ürünün satışı ve teslimine ilişkin hak ve yükümlülükleri, 6502 sayılı Tüketicinin Korunması Hakkında Kanun ve Mesafeli Sözleşmeler Yönetmeliği'ne göre düzenler. Ürünün temel özellikleri, adedi, KDV dahil fiyatı, kargo ücreti, ödeme şekli ve teslimat adresi ürün sayfasında, sipariş özetinde ve sipariş onay e-postasında yer alır ve bu sözleşmenin parçasıdır. Alıcı, bu bilgileri ve sözleşmeyi siparişi onaylamadan önce okuduğunu kabul eder.

Madde 3 – Sipariş ve ödeme

Sipariş; ürünü sepete ekleme, teslimat ve ödeme bilgilerini girme ve sipariş özetini onaylama adımlarıyla verilir. Alıcı, onaydan önce özet ekranında bilgilerini kontrol edip düzeltebilir. "Siparişi tamamla" düğmesine basılması ödeme yükümlülüğü doğurur.

Ödemeler PayTR altyapısı üzerinden kredi veya banka kartıyla alınır; kart bilgileri Satıcı tarafından saklanmaz. Taksitli alımlarda Alıcı ile bankası arasındaki sözleşme geçerlidir.

Sipariş, Alıcı'ya e-postayla teyit edilir. Sözleşme Satıcı tarafından saklanır ve talep halinde e-postayla tekrar gönderilir.

Madde 4 – Teslimat

Ürün, Alıcı'nın belirttiği adrese kargo ile teslim edilir. Teslim süresi sipariş tarihinden itibaren en geç 30 gündür; bu süre aşılırsa Alıcı sözleşmeyi feshedebilir ve ödediği tüm tutar 14 gün içinde iade edilir. Ürün Alıcı'ya teslim edilene kadar kayıp ve hasardan Satıcı sorumludur. Yurt dışı gönderimlerde varış ülkesindeki gümrük vergisi ve harçlar Alıcı'ya aittir.

Madde 5 – Cayma hakkı

Alıcı, ürünü teslim aldığı tarihten itibaren 14 gün içinde hiçbir gerekçe göstermeden ve ceza ödemeden sözleşmeden cayabilir. İndirimli veya kampanyalı ürünler de buna dahildir. Cayma bildirimi bu süre içinde info@roumelieorientale.com adresine e-postayla yapılır.

Alıcı, ürünü bildirimden itibaren 14 gün içinde Satıcı'nın iade için belirlediği kargo firmasi ile ve Satıcı'nın ilettiği iade koduyla gönderir; bu iadede Alıcı'dan kargo ücreti alınmaz. Satıcı, ürün kargoya teslim edildikten sonra 14 gün içinde ödenen tutarı Alıcı'nın ödeme yaptığı karta iade eder; siparişin tamamı iade edilirse ilk kargo ücreti de iade edilir.

Ürünün incelemenin ötesinde kullanılması (ör. yıkanması, lekelenmesi) nedeniyle oluşan değer kaybından Alıcı sorumludur. Alıcı'nın isteğiyle kişiye özel hazırlanan ürünlerde (ör. özel ölçü veya isim işlemesi) cayma hakkı kullanılamaz.

Madde 6 – Ayıplı ürün

Ürün ayıplı veya hasarlı ulaşırsa Alıcı, 6502 sayılı Kanun'un 11. maddesi uyarınca bedel iadesi, ayıp oranında indirim, ücretsiz onarım veya ayıpsız ürünle değişim haklarından birini seçebilir. Bu durumdaki tüm kargo masrafları Satıcı'ya aittir. Ayıba ilişkin talepler teslimden itibaren 2 yıl içinde ileri sürülebilir.

Madde 7 – Uyuşmazlıklar

Alıcı şikâyetlerini info@roumelieorientale.com adresine iletebilir. Ticaret Bakanlığı'nca her yıl belirlenen parasal sınırın altındaki uyuşmazlıklarda Alıcı'nın yerleşim yerindeki veya işlemin yapıldığı yerdeki tüketici hakem heyetine; bu sınırın üzerindeki uyuşmazlıklarda arabulucuya başvurulduktan sonra tüketici mahkemesine başvurulabilir.

Madde 8 – Yürürlük

Sözleşme, Alıcı'nın siparişi onaylamasıyla kurulur ve sipariş onay e-postasıyla Alıcı'ya gönderilir.

Yurt içinde: kargo firmaları, PayTR ve bankalar, mali müşavir ve e-fatura hizmet sağlayıcısı, yetkili kamu kurumları. Yurt dışında: sitemizin altyapı sağlayıcısı Shopify ile, izin vermeniz halinde Google ve Meta (analitik ve reklam çerezleri). Yurt dışı aktarımlar KVKK'nın 9. maddesine uygun şekilde yapılır.

Zorunlu çerezler sitenin çalışması için kullanılır. Analitik ve reklam çerezleri yalnızca çerez bannerında izin verirseniz çalışır; izninizi dilediğiniz zaman geri alabilirsiniz.

Saklama süresi

Verileriniz mevzuatın öngördüğü süreler boyunca saklanır (sipariş ve fatura kayıtları 10 yıl); süre sonunda silinir veya anonim hale getirilir.

Haklarınız
